President Tim Moss called the meeting to order.

Tom made a motion to nominate Maggie Moss-Tiller to Board as a member at large and assistant Dock Master. She’s researching HOA bylaws in Idaho and other states. The motion was seconded and all agreed.

Agenda:

  1. Revision/update of Policies 0303 dated 2006 and 2008.

Both policies address use of Boisen Loop and use of beachfront property. The direction was to make these into two separate policies. Re Boisen Loop, signage was discussed. Judy made a motion to ensure signage at both ends of the road said “Private Property”. It was seconded, unanimously approved. In addition, a statement re: violations will be added to Policy -Use of Beachfront Property.  Mica Kidd Island Fire Dept contact information will be added to the policies. Judy will make the new revisions and they will be finalized and approved at the next board meeting. Then all revised policies will be mailed to homeowners.

 Judy files an annual report every year to the State of Idaho declaring HOA as active and makes any necessary changes re: Board Members. Tim Moss replaces Don Sharp as Registered Agent.

The new sign in front of Bahr’s was discussed. It states the area in front of his 3 properties are Private Property and usage needs to be approved by owner. If not, cars will be towed at owners expense. Construction workers have been leaving trash in the area. Board will talk with him to verify all the property is his and possibly change the wording. Construction is almost completed. 

Tim has two bids for resurfacing Boisen Loop – $60,000 to $88,000. Getting another bid for chip sealing. 

  1. New Business

We need a Short Term Rental policy since we now have 4 short term rentals and one of them may be renting to 20 guests, Suggestions for requirements are:

        Homeowner needs to notify HOA Board every year they do short term renting.

        Homeowner needs to notify neighbors and any other homeowner with whom they share docks.

        Homeowner needs to give renters all HOA policies

  • Board Meeting was called regarding doc permits. Tim Moss and Don Sharp met with the Dept of Lands. It was determined that a new Dock Policy is in process concerning the distinction of our docks as “private”. Don is in the process of rewriting the Dock Policy and will notify Members.
  • Discussion ensued increasing the annual HOA dues to establish a reserve fund for unexpected expenses such as dead tree removal and road maintenance.
  • The Board discussed raising the annual dues from $100 a year to $250 for the 2022-2023 fiscal year. A motion was made and seconded to raise the dues for the next fiscal year to $250. The Board Members present voted and approved.

There being no further business, Don Sharp motioned and Judy Bauer seconded the motion that the meeting be adjourned.

On January 26th the Kidd Island Bay HOA Board met via Zoom to deal with the wind damage that occurred on our community property on January 13th. After much discussion the 5 members voted to assess each lot (61 in all) $100 per lot to cover costs of removing downed trees on the Community Waterfront and Boisen Loop – $8250. The due date was voted to be March 1, 2021. The Board has not approved reductions in assessments for any owners of more than 1 lot.

The annual KIB HOA meeting for all members, scheduled for August 1, 2020, was canceled due to COVID19.

Agenda:

  • Treasurer’s Report:  

Judy Bauer presented the HOA’s final financial report as of June 30, 2020 – balance $5,055.14. Judy emailed the report to board members before the meeting. The final financial report was approved and will be posted on our website: www.kibha.org. All dues were collected except from owners of U16. Registered letters were sent twice to both owners and returned as non-forwardable. Carol Ruyf is researching Kootenai tax office for hopefully new address.

  • Old Business:

Ace Sealcoating completed the cleaning and sealing of Boisen Loop and Vanilla Court. 

Sand was purchased and delivered to both beaches. Both beaches were cleaned of weeds prior to Board members spreading the sand. President covered an open drain pipe in brook by lot 5 to make it safer. The 

additional parking area the membership approved at last years annual meeting is on hold while 3 lots – U11,U12 and U13 are building. These 3 new homes will enter from Boisen Loop. The Board purchased a battery operated weed whacker and leaf blower. 

  • New Business

New gravel will be purchased for parking area on south east side of Boisen Loop. Tim Moss will order.

Judy reported that several neighbors are complaining re: barking dogs in U25. Don will call new owner since he needs to complete dock issues with 2 other dock owners. He will notify him of barking dog issue. Dog owners are encouraged to pick up after their animals.

  • Election of Officers

Since the annual meeting for all lot owners was canceled for the year due to Covid19, President Moss polled the elected Board Members present to see if they are willing to continue in their current positions. President Tim Moss, VP Don Sharp, Secretary Tim Ball and Treasurer Judy Bauer all agreed to continue in their positions for another year. 

There being no further business to discuss, Tim motioned and Judy seconded that the meeting be adjourned.

2019-08-03 General Members Meeting

Tim Moss called the meeting to order.  Members present introduced themselves.

Judy presented the Income and Expense Statement for the fiscal year that ended July 31, 2019. Balance is $4,839.82. No additions or corrections. Neal Schaefer will post on our website at www.kibha.org. 

Don announced that the last vacant lot on Vanilla Ct #38 has sold. The owner is requesting his own dock. The Dept of Lands needs to approve this and per the new owner they are okay with this request. Don, as Dock Master, will ensure all the paperwork is completed. 

Tim reported that It has taken 4 years for us to get our 2 roads seal-coated. Ace Sealcoating finally completed the job with only a small increase from the original bid. However, there are still some spider cracks that need to be cutout and repaved before add’l damage occurs. The roads need to be resealed every 3 years.

Judy Bauer has requested that a battery-operated weed whacker and blower be purchased by the HOA. The one she used to trim the road before the seal-coaters came – so they could see the true edge of the road – was electric and required 3-4 extension cords. A motion was submitted and then seconded by Mike O’Halloran. All attendees approved this purchase. The HOA currently owns a gas grill and a metal detector. These 2 new items will be housed at Judy Bauer’s and may be borrowed by other homeowners. 

Wanda Condon asked who is in charge of debris (downed tree limbs,etc) on the common waterfront area. Our bylaws state that each home owner needs to take care of the property in front of their home. All attendees agreed. Currently all homeowners are maintaining the grass along the waterfront. Per Tim if all homeowners wanted to hire someone to maintain the waterfront, dues would need to be increased.

The Board has researched adding an additional parking area along Boisen Loop. It would be located across from the Miller and Boisen properties on Association land. It was estimated to cost under $1000 to gravel and $2500 to pave. Lynn Ciani proposed adding new gravel to the original parking area and proceeding with excavating the new area. A motion was made and seconded. All attendees approved.

There are 2 dead trees along Boisen Loop on Association property. The Board will negotiate with Nolan Tree service to remove these dead trees.

We are required to maintain our 2 beaches. It was estimated that approximately 6 yards of sand would be needed to make the 2 beaches usable and presentable. Tim Moss will research the cost (approx $36 per yard plus delivery) and ensure this happens before winter.

There being no further new business, a motion was made by Don Sharp and seconded by Judy Bauer to adjourn the meeting. The members present unanimously approved. The Annual Picnic immediately followed.

  • Treasurer’s Report:  

Judy Bauer presented the HOA’s financial report as of June 30, 2019 – approximately $4862. Included in the balance is the payment of $5550 for road sealing. The final financial report will be presented at the annual meeting on August 3rd and posted on our website: www.kibha.org.

  • New Business:

Ace Sealcoating completed the cleaning and sealing of Boisen Loop and Vanilla Court, however there are still some alligator cracks that need to be sealed.

The Board discussed needing to replace the sand on our two beaches. Judy reported that one company indicated they would not cross our dry brook without first inspecting it. Tim Moss will check with Rock Hound that charges $36 per scoop/yd. before the annual meeting. Also need to determine delivery charge.

The Board agreed that another parking area on Boisen Loop would be a good idea and will present it at the annual meeting for discussion and vote. The parking area would be across Boisen Loop from the Miller and Boisen’s properties Association property. It is estimated that it will cost $95/hr to excavate the area. This will assist with fire truck clearance and snow storage.

Don reported that lot 38 on Vanilla Court has sold and that the new owners want to build their own Dock. They reported that the Dept of Lands has approved this. Another owner would be allowed to piggyback on the permit. Pat McQuillan has asked the Board to assist him in collecting fees from co-owners of the shared dock for recent and future repairs. The Docks are owned by the homeowners and the Board will not assist in collecting repair fees. Lynn Ciani our “house” lawyer agreed.

Lynn reported that she’s been approached by a member of the Captain Kidd HOA to see if we are interested in assisting them with weed abatement. Lynn will follow up for details.

There being no further business, Don Sharp motioned and Judy Bauer seconded the motion that the meeting be adjourned.

2018-08-04 General Members Meeting

Annual Meeting

August 4, 2018

Attendees:  Judy Bauer, Tim Moss, Don Sharpe, Adrienne Putren, Barry and Karen Sill, Jason Heffernan, Maggie Moss and Lynn Ciani

Tim called the meeting to order.  Members present introduced themselves.

Judy presented the Income and Expense Statement for the year ended July 31, 2018.

Barry requested an update regarding the Department of Lands.  Don, Judy and Tim together discussed that the KIBHOA owns the riparian rights regarding the rights abutting the lake.  The Dept. of Lands aggregated all of the privately owned docks together and declared that together they were an association and subject to the requirements for an association.

Lynn asked about the expenses for the fixing the road.  Judy stated that Mike Church is scheduled to repave the road, weather permitting, on Sept. 8 and 9.  He will be fixing the potholes ahead of time with an experimental procedure and, if the experiment does not work, refill them with the traditional method.

Barry requested information regarding the weeds in the bay.  Judy stated that the weeds are elodea, which is a weed found in aquariums.  There is an aquacide available for elodea which can be found on the lake restoration website.

Tim made a motion, seconded by Don, to approve the expenses.  The motion was approved unanimously.  

Don provided the dock report stating in conclusion that all is well.

Jason asked about the ramps to the dock and who was responsible.  Don stated that the owner(s) of each dock is responsible.  Don stated that who owns which docks is set forth on the KIBHOA website.  

It was discussed whether to put the dock numbers at the end of each dock, perhaps making it easier for fireboats to locate the dock where an issue may be.  No decision was made.

Judy read a note of thanks from Heather.

Tim than provide a report as to what occurred during the last year and provided a reminder of certain rules.  He stated that:

  • Kootenai Electric cut down 3 trees and that KIBHOA paid $400 to cut up the trees and haul them away. The trees were on KIBHOA property.
  • The roads need to be seal coated every 4 years and, as a result, it was going to be done this year.
  • He stated that certain members wanted grass where the sand areas were located.  He stated that under the regulations pertaining to the lake that if the sand areas were removed KIBHOA would never be able to obtain sand areas again.  As a result, it was decided to retain the sand areas and to get more sand.
  • Four new signs were obtained for the roads indicating that the speed limit was 12 mph.  The reason behind the 12 mph speed limit was to be different with the hope that folks would abide by the speed limit.  Jason suggested that “Children at Play” signs be used to help prevent speeders.  It was agreed that that would be a good idea.
  • The KIBHOA Policy #0302 was amended to increase the speed limit from 10 mph to 12 mph.
  • Tim reminded everyone that any changes to common areas must first be approved by the KIBHOA Board.

Upon motion made by Judy and seconded by Lynn the members present unanimously approved the adjournment of the meeting.

NOTE: Since there was no quorum at the business meeting, election of officers for the upcoming year was postponed. In October, 5 Board Members – Tim Moss, Don Sharp, Tim Ball, Judy Bauer and Rick Littlejohn met to vote on their continuation on the Board for 2019-2020. In addition Jim Ruyf resigned and his wife Carol Ruyf volunteered to replace him. Neal Schaefer and Lynn Ciani also agreed to continue on the Board.

  • Treasurer’s Report

Judy Bauer distributed the HOA’s annual income and expense report for August 1, 2016 to July 31, 2017. 100% of dues were collected. The bank balance is currently $ 7,372.39.

  • Old Business

A discussion ensued re: the high incidence of weeds in our bay. The Dept of Lands is currently working on Hayden Lake killing milfoil, a noxious weed. They have not responded to our phone calls. The University of Idaho is doing research at the mouth of the bay on our algae.  Using barley straw was offered as a solution and also Aquacide. Aquacide costs $80 for 10 lbs. We do not know the name of our weed. Still researching.

Our new parking area is working well. Need to encourage people to park diagonally. Considering chalking lines. Need to research adding another one – Possibly across from Millers.

Road signs we installed last year are still in place.

  • New Business

There are 3 dead trees along Boisen Loop. 1 is definitely on HOA property. We are looking for property lines for the other 2. John Boisen suggested calling Kootenai Electric to see if they will remove them.

It’s been 3 years since our 2 roads were sealed. The Board has called several companies to give bids but to date no one has come. The company that we hired the last time charged $5500 and we expect this year’s bid to be higher. We need at least 2 bids. Still calling.

Homeowners at the north end of Boisen Loop have requested that we cover up the sand on the north beach. They would like to plant grass to the water’s edge. This would require the approval of all 61 lot owners. We are grandfathered in to have 2 beaches. Rick Littlejohn will research to see if the north beach can be moved. He is interested in having the beach by his home. Don will report to requesting homeowners that there is dissension and we are working on it.

The Board received a letter from Fred Miller requesting that we consider cutting our HOA annual dues by 50% – from $100/yr to $50/yr. The Board met to discuss and reported back to Fred, via letter and phone call, that it’s taken us 3 years to save the money needed to repair and resurface (seal) the 2 roads. The Board voted to keep our dues at $100/yr.

  • Dock Master’s Report

Don Sharp reported that the Dock issues between Denese Schumacher and Wanda Condon have been solved. The Dept of Lands had incorrect information on ownership of their shared Dock and has apologized for their error.

Don has been notified that one of the docks at the north end of our community property is being enlarged. It is being repermitted at a cost of $2075. All the homeowners assigned to this dock will be signing their agreement and sharing in the cost.

The McQuillans are replacing 2 pilings on their Dock and the other owners have agreed to share the cost.

There being no further business, a motion was made, seconded and the members voted unanimously to adjourn.

Tim Moss, President, brought the meeting to order. Old and new members introduced themselves.

  • Treasurer’s Report

Judy Bauer, Treasurer, reported that 99% of 2015/2016 dues have been collected. One member’s dues are still outstanding and 3 late fees have been added. The HOA checking account balance is $5,532.27. This winter there was considerable wind damage to trees along Boisen Loop. Pictures were circulated. We paid to have the trees chopped and removed. The Board approved an annual budget line of $300 to pay for these kinds of repairs in the future. The HOA’s liability insurance has been increased to $2,000,000.

  • Dock Master Report:

Don Sharp, Dock Master, reported that ownership of the dock formerly owned partially by Walker, now owned by Condon and Schumacher, has been finalized and corrected paperwork has been filed.

  • Old Business:

The pothole on Boisen Loop has been repaired. Tim noted that the road should be sealed every 3 years. So possibly next year it will be needed again. The street signs at both ends of Boisen Loop needed to be replaced this year.

Making Kidd Island Bay a “no wake” zone needs the approvals of everyone living on both sides of the bay. Even buoys would need approval from the County Commissioners.

It was noted that the mailbox stands on the north end of the road are in disrepair.       However, they are on Kidd Island Rd and not on our property so we cannot repair them.

A permit is required to burn on the waterfront unless you are using the fire to cook food.

Open Discussion:

  • A discussion ensued concerning the new parking area across from lots 21-24. There was a misunderstanding re: who would use the area and who owned the area. Tim explained that the parking area is for anyone in the association who needs add’l parking. A sign will be posted indicating it is limited to 48 hr parking and that no trailers are allowed. In the future additional parking areas may be added. 
  • A question arose as to whether or not there is still an active dredging committee. According to Tim, the answer is yes. We were reminded that the state owns the bottom of the lake. 
  • The membership voted to re-elect the Board as it currently stands.  

There being no further business, a motion was made, seconded and the members voted unanimously to adjourn.
